Questions or requests: info@cclleap.com
1. About Us
1.1 Brand and Operation: CCLLeap ("the Platform", "we", "us", or "our") is an independent online language learning and exam preparation platform brand, independently operated by the CCLLeap team. The Platform has no agency, representative, or authorisation relationship with any official examining body, government agency, or educational institution.
1.2 Contact: For any questions about these Terms, please contact info@cclleap.com.
1.3 Changes in Operating Entity: Should the operating entity or legal structure of the Platform change, we will update these Terms accordingly and notify you in accordance with clause 2.2. Such a change will not affect rights you accrued before the change took effect.
2. Acceptance and Changes
2.1 Acceptance: By registering an account, completing a payment, or accessing and using the Platform in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please stop using the Platform.
2.2 Changes: We may amend these Terms from time to time. Amended Terms will be published on the Platform and take effect on the date of publication. For material changes affecting fees, the scope of services, or your rights, we will give you at least 14 days' notice via your registered email address or an in-Platform notice. Continued use of the Platform after the effective date constitutes acceptance of the amended Terms; if you do not agree, you may stop using the Platform.
3. The Service
3.1 Service: The Platform provides online language practice, mock examinations, AI speech recognition and scoring, text transcription, and one-on-one evaluation and guidance by qualified instructors (including NAATI-certified individuals). Certain subscription tiers also include one-on-one live tutoring sessions (see clause 6.7).
3.2 Non-Affiliation: CCLLeap is an independently operated third-party educational technology platform and has no official affiliation, sponsorship, partnership, authorisation, or endorsement relationship with NAATI (National Accreditation Authority for Translators and Interpreters). The Platform does not use "NAATI" as part of its brand identity or course naming.
3.3 Originality of Materials: All practice materials, mock tests, and teaching resources are independently created, originally written, restructured, or adapted from open academic resources. We strictly comply with intellectual property laws and do not include, leak, or distribute any official confidential NAATI exam materials. Any resemblance to actual exam content arises from the inherent regularities of language teaching and everyday conversational scenarios.
3.4 Copyright Notice: If you believe Platform content infringes your copyright, please send a written notice with proof of ownership to info@cclleap.com. We will promptly take down or modify any disputed content following verification.
3.5 No Guarantee of Results: AI scores, practice ratings, commentary, and instructor feedback are provided for reference and practice purposes only. We make no guarantee that use of our services will result in a passing grade or any specific outcome in official NAATI examinations.
4. Accounts and Use
4.1 Registration: You must provide true, accurate, and valid registration information, including a valid email address.
4.2 Account Exclusivity: Accounts are strictly for the individual learning use of the registered user. Renting, lending, reselling, sharing, multi-person use, or commercial distribution of account access to any third party is strictly prohibited.
4.3 Prohibited Conduct: The use of web scrapers, automated scripts, screen recorders, or audio extraction tools to bulk-scrape Platform content is prohibited; copying or reverse-engineering the Platform's software is prohibited; and copying, transcribing, forwarding, reposting, publicly sharing, or distributing the Platform's course materials, practice questions, audio, or scoring content by any means is prohibited, whether or not for profit.
4.4 Security Monitoring and Enforcement: Automated systems monitor login and access activity to identify abnormal logins, account sharing, and the prohibited conduct above.
- Where suspected breach is identified, we will notify you at your registered email address. You may appeal within 10 business days, and we will complete a review and respond within 10 business days of receiving your appeal.
- For serious breaches such as bulk scraping, reselling accounts, commercial trafficking, or intellectual property infringement, we may suspend or terminate the account immediately without refund and reserve the right to pursue legal remedies.
- We understand that IP changes or multi-device logins may occur when you are travelling, using a VPN, switching between public Wi-Fi networks, or changing devices. Such normal use does not constitute a breach.
5. Intellectual Property and Your Recordings
5.1 Platform Content: All content on the Platform (including software code, UI designs, text, audio materials, AI evaluation logic, trademarks, course architecture, and interface layout) is the intellectual property of CCLLeap. No scraping, reproduction, transcription, forwarding, reposting, or distribution of any content is permitted without written authorisation, whether or not for profit.
5.2 Your Recordings Remain Yours: You retain original ownership of the audio files you record and submit and of your text answer records.
5.3 Licence Scope: To enable us to provide the services to you, you grant us a non-exclusive, royalty-free, non-sublicensable licence to store, access, and process those audio files to the extent necessary to provide the services to you, including: generating AI evaluations, routing recordings to certified instructors for feedback, and generating learning reports.
This licence terminates upon closure of your account. The actual retention period for audio files is set out in clause 3.2 of the Privacy Policy. We may engage cloud hosting or AI speech recognition providers to process the data, but we will not sublicense your audio to any third party for their own purposes.
5.4 Deletion: Audio files, transcripts, and answer records are not retained long-term — where no instructor feedback applies, they are deleted within 7 days of scoring; where one-on-one instructor feedback applies, within 30 days of feedback being completed. Scoring reports and instructor comments are retained in your account for your own review and are deleted or anonymised within 30 days after you close your account. See clause 3.2 of the Privacy Policy. Records required by law are excepted.
6. Subscriptions, Payment, and Refunds
6.1 Subscriptions: We offer free tier access and recurring paid subscriptions at multiple tiers, billed monthly or per term. Subscription fees and included entitlements are stated on the purchase page. All payments are securely processed by our licensed payment service provider; we do not access or store your full card details. Paid plans renew automatically. Whether the next period is charged depends on when you cancel: if you cancel before the next billing date, no further charge is made; if you cancel on or after that date, the fee for that period is charged as usual and you may continue to use the service until the end of that period. You may cancel online at any time via your account settings, without needing to contact support. The distinction between cancelling and obtaining a refund is set out in clause 6.3(3).
6.2 Payment Methods and Currency: The Platform offers the following payment methods through its licensed payment service provider: credit/debit card, bank transfer, Alipay, and WeChat Pay. The methods actually available are those displayed at checkout.
- The billing currency is Australian dollars (AUD).: If you pay through a non-AUD channel, the amount debited is converted by the payment provider at the prevailing transaction rate. Any exchange-rate difference, currency conversion fee, or cross-border transaction fee charged by your card issuer or payment institution is borne by you; we charge no additional fee.
- Goods and Services Tax (GST): Prices are shown in Australian dollars (AUD) as a single all-in amount — the price you see is the price you pay, and no GST is added at checkout. For Australian tax residents, the amount payable is GST-inclusive. Customers who are not Australian tax residents are not charged Australian GST.
- Bank transfer: Please include the payment reference shown at checkout when making your transfer. A missing or incorrect reference may prevent the payment from being matched and delay activation. Your subscription is activated from the date we confirm receipt of cleared funds, not the date you initiate the transfer.
- Third-party payment: Where someone else (for example, a parent) pays on your behalf, we treat that payment as authorised by the account holder; you, as the registered user, remain the responsible party under these Terms.
- All payments are subject to verification by the payment provider. If a payment fails, is reversed, or does not clear, we may suspend or terminate the relevant subscription.
- Your bank or payment statement may show "CCLLeap" or the name of the payment service provider.
6.3 Refund Policy:
(1) General principle: Given the immediate delivery characteristics of digital content, AI computing resources, and SaaS services, all paid subscriptions are non-refundable once payment is completed. This clause applies to the extent permitted by applicable law.
(2) The following do not constitute grounds for a refund: (the service having been delivered as agreed):
- a change of mind, a change of personal plans, or no longer needing the service;
- failure to use the service during the subscription period, or only partial use;
- not passing the NAATI CCL examination, or being dissatisfied with your examination result (the Platform is a preparation aid and does not guarantee examination outcomes);
- not completing a study plan, or not reaching an expected level of progress, within the subscription period;
- subscription periods already delivered, instructor feedback quotas already used, or unused live-tutoring sessions within a period (see clause 6.7).
(3) Cancellation is not a refund: Cancelling a subscription only stops future automatic renewals and does not refund the fee for the current paid period; after cancelling, you may continue to use the service until the end of the current period. See clause 6.1 for how the timing of cancellation affects charges.
(4) Statutory consumer guarantees prevail: Nothing in this clause excludes or limits your non-excludable statutory consumer guarantee rights under the Australian Consumer Law (ACL).
- Where the service has a major failure (for example, the service is entirely unusable, instructor feedback is not provided as agreed, or the service is materially inconsistent with its description), you are entitled to choose the applicable remedy under law, which may include a refund — and the law prevails even if this is inconsistent with paragraph (1) above.
- Where a failure is not a major failure, we are entitled to choose to re-supply or remedy the service within a reasonable time (for example, by re-marking an assessment, extending your subscription, or providing equivalent entitlements) rather than necessarily issuing a refund.
(5) Duplicate charges and system errors: Duplicate charges or incorrect amounts caused by us or our payment provider will be fully refunded following verification.
(6) Refund method and timing: Approved refunds are returned to the original payment method (credit card, Alipay, or WeChat Pay reversals; bank transfers are returned to the originating account, for which you must provide the account details). We will initiate the refund within 10 business days of approval. Actual receipt depends on the payment provider and your bank. We do not compensate for exchange-rate differences or third-party fees.
(7) How to request: Please submit refund requests to info@cclleap.com with your order number and payment evidence. We will respond within 10 business days.
(8) Termination for breach: If your account is terminated for breach of these Terms (such as fraud, account sharing, bulk scraping, or resale), fees already paid are non-refundable, without prejudice to our other rights.
6.4 Payment Processing and Settlement: Subscription payments are processed by a licensed payment service provider and may be settled through the payment account of a partner organisation. This settlement arrangement is a payment channel only; it does not affect your rights or our obligations under these Terms, and does not alter the brand ownership or operational independence of the service. Receipts, invoices, and refunds are issued in the Platform's name; refund requests are received and handled by the Platform. For any payment queries, contact info@cclleap.com.
6.5 Disputes, Chargebacks, and Account Suspension:
- If you dispute a payment, please contact us first at info@cclleap.com; we will respond within 10 business days.
- If you raise a chargeback or payment dispute with your card issuer or payment provider without contacting us first, we may suspend your account access pending resolution.
- Where a chargeback is found to be without valid grounds (for example, where the service was provided as agreed), you are liable for the dispute fees and reasonable costs we incur; we may set these off against other amounts due to you or recover them at law.
- This clause does not affect your right to lodge a complaint with a regulator or to seek a remedy under law.
6.6 Instructor Feedback: Users with "One-on-One Instructor Feedback" entitlements will typically receive evaluations within 5 business days of submission (calculated from the time of submission, excluding weekends and public holidays). Turnaround may be extended during peak periods. Feedback quotas are valid only within the active subscription cycle and cannot be accumulated across periods or redeemed for cash.
6.7 One-on-One Live Tutoring (Sprint Plan): The "Sprint Plan" subscription includes two 30-minute one-on-one sessions with a live tutor per month (online or in person; the format will be confirmed by us). The following rules apply:
- Current period only; no accumulation: Sessions are valid only within the active subscription period. Unused sessions lapse automatically at the end of the period and do not carry over, accumulate, convert to cash, or become refundable.
- Advance booking required: Please book by emailing info@cclleap.com at least 3 business days in advance, stating your account email address and your preferred time slots. The session time is confirmed only when we confirm it by email; a request is not treated as a confirmed booking until then.
- Rescheduling and no-shows: If you need to reschedule, please notify us at least 24 hours before the session begins; one free reschedule is permitted. If you notify us less than 24 hours beforehand, or do not attend, the session is treated as forfeited by you, and will not be made up, refunded, or converted to cash.
- This entitlement is a teaching service included in the subscription, is available only to Sprint Plan subscribers, and may not be transferred or redeemed for cash.
7. Limitations of AI Technology
7.1 Technical Limits: Our AI evaluation system is based on statistical and deep-learning algorithms designed to offer practice references.
7.2 Disclaimer: AI scores do not reflect official examiner subjective grading standards. You acknowledge that AI scores may vary due to microphone quality, background noise, network latency, or accent differences. We provide no express or implied warranty regarding the absolute accuracy or fitness for a particular purpose of AI results.
7.3 Instructor Feedback: Where your subscription includes a "One-on-One Instructor Feedback" entitlement, your submitted recordings will be evaluated by a certified instructor (see clause 6.6). This entitlement is a teaching service included in the relevant subscription and is available only to subscribers of that plan. Booking and rescheduling rules for one-on-one live tutoring are set out in clause 6.7.
8. Limitation of Liability
8.1 Limitation: To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential loss arising from the use of, or inability to use, the Platform. Our aggregate liability shall not exceed the total subscription fees you paid in the preceding 12 months.
8.2 Statutory Rights Prevail: Clause 8.1 does not apply to liability arising from a failure of our services to meet a consumer guarantee that cannot be excluded under the Australian Consumer Law. Where applicable law does not permit a liability to be limited or excluded, this clause does not apply to that liability.
8.3 Force Majeure: We are not liable for service interruptions or delays caused by events beyond our reasonable control, including natural disasters, power or telecommunications outages, cloud provider failures, epidemics, or government acts.
9. Governing Law and Disputes
9.1 Governing Law: These Terms are governed by the laws of New South Wales, Australia.
9.2 Mandatory Protections Preserved: These Terms do not exclude or limit any rights you have under the mandatory consumer protection laws of your own jurisdiction.
9.3 Disputes: In the event of a dispute, please contact us first at info@cclleap.com to resolve it amicably. If unresolved, the dispute shall be submitted to a court of competent jurisdiction in New South Wales, Australia. This clause does not affect your right to lodge a complaint with any relevant regulator.
10. General
10.1 Severability: If any provision is held invalid or unenforceable, it shall be limited or severed to the minimum extent necessary, and the remaining provisions continue in effect.
10.2 Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement regarding the Platform's services.
10.3 No Waiver: Our failure to exercise any right under these Terms does not constitute a waiver of that right.
10.4 Survival: Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and governing law) continue in effect after your account terminates.
10.5 Language: These Terms are governed by the English version.
